  • The Social Security appeals process can vary from state to state. In most states, the first appeal is known as a "request for reconsideration." There is no reconsideration in ten states, including Pennsylvania, New York, California and Florida. If denied, the second stage of the appeals process is a request for a hearing before an administrative law judge. If you are denied Social Security benefits at this stage, you can request to have your case reviewed by the Appeals Council.
  • Although the majority of our clients' claims do not need to be appealed past the Appeals Council, you still have the right to appeal your case to federal court.
  • Don’t give up if you are denied. Most people are denied benefits at the first level, but more than half win at hearings.
