- The Social Security appeals process can vary from state to state. In most states, the first appeal is known as a "request for reconsideration." There is no reconsideration in ten states, including Pennsylvania, New York, California and Florida. If denied, the second stage of the appeals process is a request for a hearing before an administrative law judge. If you are denied Social Security benefits at this stage, you can request to have your case reviewed by the Appeals Council.
